Filter in louver door - code violation?

I am in the process of purchasing a new construction townhouse. During the inspection, the inspector pointed out that the filter for the air return is not attached to the air handler. The air handler is in a small room (essentially a closet) with a louvered door. The filter is simply inserted into a frame behind the louvers. Air is going under the door and the filter is being pulled back so that even the air that goes through the louver is bypassing the filter. The coils are already very dirty (this is brand new construction). The developer is claiming that this is acceptable. (The air handler is a trane tem6 4 ton unit.)

Does this violate residential building code? This is the easiest way for me to demand that this issue is corrected.

Can a filter be installed in louver door in a way that does provide adequate filtration?
