How to fire installers and have them remove non-functioning system [UPDATE from earlier post]

Long story short, I had a new system installed in the upstairs of my home about 2 months ago. Since then, the system has not been able to keep the area below 78 degrees on the hottest days (~90 outside). The company has sent a tech out to the house at least 6 times to tweak/investigate. Each time, they manage to find something wrong (coolant too low, hose crimped, etc), but none of these "fixes" to their new install have worked. Instead, I spend every day of the summer in 78 degree working conditions. Can't do it any more. The last tech visit on Friday resulted in them deciding I need to insulate my ceiling to prevent the ducts from losing cool air.

I'd buy that, except that these are the same flex runs that the previous system used and worked just fine (and the old system was 2 ton, the new system is 2.5 ton). Additionally, my laser thermometer tells me that the ceiling temp is lower than the air temp. So, I'm at a loss with this company. I have another vendor coming out on Monday to quote me for a complete installation.

My question is this, can I simply tell the incompetent installer to remove his system from my property? There was never a signed contract and I, obviously, have not paid them a dime for their ineffective work.

Any advice, should I decide to be done with this company and switch to a different installer?
